Please read these Terms and Conditions ("Terms") carefully before using the AutoTrace Kenya platform ("Service") operated by AutoTrace Kenya Ltd ("we", "us", or "AutoTrace"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
AutoTrace Kenya is an online vehicle history information platform. The Service allows consumers to query vehicle history records by entering a Kenya vehicle registration number. Records in the platform are submitted by registered third-party data providers — commercial entities such as motor vehicle dealers, licensed vehicle importers, motor vehicle auction representatives, finance and logbook loan institutions, motor vehicle inspection companies, insurance providers, and motor vehicle service centres (collectively, "Providers").
The data available through the Service may include, where submitted by a Provider: import and auction history, finance and logbook loan records, mileage timeline, accident and damage history, insurance claims, physical inspection records, service and maintenance records, ownership and sale history, theft and recovery records, and commercial use declarations.
AutoTrace does not own, generate, or independently verify the records submitted by Providers. We are not connected to, affiliated with, or operating as an agent of any government agency, including the National Transport and Safety Authority (NTSA) or the Kenya Revenue Authority (KRA). Records on the platform reflect only what registered Providers have chosen to submit.
2. Eligibility and Account
You must be at least 18 years of age and legally capable of entering contracts under the laws of Kenya to use the Service. By creating an account or making a payment you represent and warrant that this is the case.
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@autotrace.co.ke if you suspect unauthorised access to your account.
3. Payment and Report Access
3.1 Fees
Access to a vehicle history report requires payment of the applicable fee displayed at the time of purchase. All prices are quoted in Kenya Shillings (KES) and are inclusive of applicable taxes unless otherwise stated.
3.2 Payment Methods
We accept M-Pesa, Visa, and Mastercard payments processed through Paystack, a licensed payment service provider. Payment is debited at the point of purchase. AutoTrace does not store card numbers or M-Pesa PINs; all sensitive payment data is handled exclusively by Paystack in accordance with PCI-DSS standards.
3.3 Promotional Credits
AutoTrace may from time to time issue promotional access credits. Credits are non-transferable, have no cash value, and expire on the date stated when issued.
3.4 Refund Policy
Vehicle history reports are digital products delivered immediately upon successful payment. Because they are consumed at the point of delivery, payments are non-refundable except in the following circumstances:
- The report is entirely blank due to a confirmed platform fault (as distinct from a vehicle having no records on the platform).
- The same report was charged twice for an identical transaction within a single session.
- The payment was processed but the report was never delivered due to a verified platform error.
A report that returns no records is not a platform fault. The absence of records means no registered Provider has submitted history for that vehicle to the platform. This outcome does not qualify for a refund.
To request a refund under the eligible exceptions, contact support@autotrace.co.ke within 7 calendar days of the transaction, quoting your transaction reference. Approved refunds are processed within 10 business days via the original payment method.
4. Accuracy and Completeness of Reports
AutoTrace aggregates and presents records submitted by registered Providers. We do not independently verify, audit, or guarantee the accuracy, completeness, or currency of those records.
The platform has no integration with NTSA, KRA, or any other government agency. A report from AutoTrace Kenya does not constitute an official government record and should not be treated as one. It reflects only information that Providers have voluntarily submitted to the platform.
A report is an informational tool only. It is not a guarantee of a vehicle's mechanical condition, legal ownership, or freedom from financial encumbrance. You should conduct your own independent verification — including a physical inspection of the vehicle and, where appropriate, a search at the relevant government registries — before purchasing any vehicle.
AutoTrace is not liable for decisions made by you or any third party based on the information in a report. See clause 8 (Limitation of Liability).
5. Intellectual Property
All platform software, design, layout, and compiled report formats are the intellectual property of AutoTrace Kenya Ltd and are protected under the Kenya Copyright Act, 2001.
You may download a personal copy of a purchased report for your own non-commercial use only. You may not reproduce, redistribute, resell, or create derivative works from platform content without our prior written consent.
6. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable Kenyan or international law.
- Scrape, crawl, or extract data from the platform by automated means without written authorisation.
- Attempt to reverse-engineer, decompile, or tamper with any part of the platform.
- Submit false, misleading, or fraudulent information in connection with a search or payment.
- Resell, sublicense, or commercially exploit reports or any data obtained through the platform.
- Attempt to circumvent the paywall or access reports without completing payment.
- Use the Service in a manner that violates the Kenya Computer Misuse and Cybercrimes Act, 2018.
We reserve the right to suspend or terminate accounts and to report suspected criminal conduct to relevant authorities, including the Directorate of Criminal Investigations (DCI).
7. Third-Party Links
The Service may contain links to third-party websites provided for informational purposes only. AutoTrace does not endorse and is not responsible for the content, privacy practices, or availability of third-party sites.
8. Limitation of Liability
To the maximum extent permitted by the laws of Kenya, AutoTrace Kenya Ltd and its directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, data, goodwill, or business opportunities.
- Losses arising from reliance on inaccurate, incomplete, or outdated Provider data.
- Losses arising from information that a Provider failed to submit to the platform.
- Any interruption or unavailability of the Service.
Our total aggregate liability in respect of any claim shall not exceed the amount you paid for the specific report that gave rise to the claim.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as required by the Consumer Protection Act, 2012 of Kenya.
9. Indemnification
You agree to indemnify and hold harmless AutoTrace Kenya Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms or unlawful use of the Service.
10. Consumer Rights
Nothing in these Terms limits rights you hold under the Kenya Consumer Protection Act, 2012, including the right to accurate information about the services you purchase. Where any provision of these Terms conflicts with a right granted under that Act, the statutory right prevails.
11. Changes to the Service and Terms
We reserve the right to modify or discontinue the Service at any time with reasonable notice for material changes. We will update the "Last updated" date at the top of this page when Terms change. Continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Disputes shall first be referred to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration in Nairobi under the rules of the Nairobi Centre for International Arbitration (NCIA), conducted in English. Neither party is prevented from seeking urgent injunctive relief from a Kenyan court of competent jurisdiction.
13. General
If any provision of these Terms is unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoTrace Kenya Ltd in relation to the Service.
